States will be able to charge sales tax on online purchases thanks to the Supreme Court

最高裁が下した判決により州はネット通販にも売上税を課すことができるだろう。

In a five-to-four decision issued today, the Supreme Court ruled that states can make online businesses collect sales taxes — even if they don’t have a physical presence in that state.Today’s ruling overturns a decision from the Court in 1992 that paved the way for the explosion of online retail in the United States.

※sales tax: 消費税、売上税(アメリカでは消費税ではなく、売上税)
消費税は製造業者から消費者まで商品を購入する度に課せれますが、売上税は最終消費者が購入した時のみ課されます。売上税は州によって異なります。

訳すと、「本日下された5対4の判決で、企業がその州に物理的な拠点を持たなくても、ネット通販にも売上税を徴収できるようにすると最高裁は決定した。

今日の判決は、アメリカにおいてネット通販企業の急拡大の要因となった1992年の最高裁の判断を覆すことになる。」

アメリカでは、オンライン小売業者は売上税が課されていなかったため、実店舗に比べて優位でした。

 

At issue was the Quill Corp. v. North Dakota decision, which ruled that companies need to have at least some physical connection with a state for that state to require that company to pay taxes.

訳すと、「問題となったのは、Quill corpとノースダコタ州の判決で、同社が税金を納めるよう州が要求するにはその州との物理的なつながり(店舗や生産拠点などの物理的な拠点)が必要であるとの判決が下された。」

The Quill Corpとノースダコタ州の判決は1992年にくだされ、これ以来オンライン小売業者は有利な立場にあったということですね。

今回は、サウスダコタ州とWAYFAIRというオンライン小売業者が争っていたようです。

 

Today’s ruling caused publicly traded e-commerce company share prices to tumble, with Shopify, Etsy, Amazon, eBay, Alibaba all recording losses in midday trading on their respective U.S. exchanges.

訳すと、「今日の判決により、Shopify、Etsy、Amazon、eBay、Alibabaが米国取引所で正午の取引で損失を記録したために、eコマース企業の株価は暴落した。」

21日の米国株式市場でアマゾンの株価は1.1%安、中小業者にオンライン販売のプラットフォームを提供するeBayやEtsyもそれぞれ3.2%安、1.4%安となったそうです。

それとは対照的に、小売大手であるターゲットは1%上昇、ウォルマートも0.7%上昇したとのことです。

 

It’s a huge win for vendors with physical storefronts, which have long argued that their online counterparts enjoyed an unfair advantage because they didn’t have to charge customers local sales tax. Local governments may also see a windfall as a result of the ruling, as the government estimates that between $9 billion and $13 billion in potential tax revenue is left on the table, thanks to earlier Supreme Court decisions on the taxation of online purchases.

訳すと、「ネット通販は顧客に売上税を請求する必要がないため、不当な利益を享受してきたと訴えてきた物理的な店頭を持つベンダーにとって、これは大きな勝利である。

この最高裁の判決により、政府は潜在的な税収が90億ドルから120億ドルになると見積もっているため、地方政府にとってまさにたなぼたとなるだろう。」

これは大きな額ですね!まさにたなぼた。

今回の判決を受けて、今後も他の州で売上税に関する訴訟が相次いで起こりそうです。

While the ruling opens the door for states to collect taxes from online businesses, there’re some significant outstanding questions now that the court has made its decision.

訳すと、「判決が州がネット通販から税金を徴収することを可能にした一方で、これには重大な問題点がいくつかある。」

問題点とは何でしょうか。見ていきましょう。
